BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO THESE TERMS, WHICH INCLUDE MANDATORY PROVISIONS SUCH AS PROVIDING YOUR AUTHENTIC INFORMATION DURING REGISTRATION AND LISTING OF SERVICES, YOUR COMMITMENTS TOWARDS RENDER BOOKING, ACTIVITIES PROHIBITED BY RENDER BOOKING, DISPUTE RESOLUTIONS AND THEIR PROCESS, OTHER LEGAL MATTERS, SPECIFIC TERMS FOR BUSINESS PARTNERS, GENERAL PROVISIONS, AND PRIVACY POLICIES.
1.Introduction
Render Booking offers a comprehensive digital platform for travelers seeking exceptional experiences in Nepal. Our platform, accessible online and via mobile application, connects users with a wide range of tourism and hospitality services. By accessing or using our platform, including communicating with us or engaging with our content, you agree to comply with and be legally bound by these Terms and Conditions. These Terms and Conditions govern your use of our platform and constitute a binding agreement between you and Render Booking. These Terms and Conditions, along with our cancellation policy, privacy policy, and other relevant terms and conditions (collectively, the “Policies”), form the “Agreement” between you and Render Booking. We provide detailed information on each reservation and booking, accessible through our platform, which can be used as proof of service.1.1 Modification
Render Booking reserves the exclusive right to modify our platform or the Agreement, including these “Terms and Conditions” as necessary. In addition to this, such modifications can also be made subject to changes in government rules and regulations. Any changes will be acknowledged and posted on our platform with an updated “Last Revised” date. Use of our platform after such changes are posted in our platform shall be deemed to have agreed to the modified terms and conditions. If the updated terms are unacceptable, your sole recourse is to stop using our platform.1.2 Our Business Partners
Render Booking, a service provider as a premier digital platform, thrives through strong partnerships with various service providers. Our esteemed Business Partners referred to as “Merchants/Vendors”, include Vehicle Rental Service Providers (both individual and business entities), Hotels, Travel and Tour Agencies, and Visa Service Providers. Partnering with Render Booking involves adhering to specific procedures and establishing a mutual agreement between the two parties Render Booking and the Merchants.1.3 Our Clients
At Render Booking, our clients as “Service Users”, encompass anyone seeking a variety of services listed on our platform. These services include Vehicle Rental Services, Visa Services, and many more exciting offerings in the pipeline. Whether you are looking for reliable transportation, visa assistance, or other travel-related services, Render Booking is your one-stop solution for all your needs.2. Requirements for Business Partners (Merchants/ Vendors)
Our services are available exclusively to individuals or businesses that meet the following criteria: Business must be registered: Applicant’s business must be registered as per the prevailing laws in local country and the nature of business shall be tourism or hospitality. Must be registered in PAN/VAT: Applicants must be registered with VAT/PAN. Individual Partner: Any individual who has owned at least one vehicle, being registered in PAN and whether or not have registered as a business entity shall be deemed as an “Individual Merchant”.3. Registration for Business Partner (Merchants/ Vendors)
To access certain features of our services, you must create an account with Render Booking (a "Render Booking Account"). You can register by providing the following information: For Individuals/ Businesses Authentic email address. Personal residence or office address as applicable. Valid landline/ mobile number. Copy of PAN/VAT and Business Registration (applicable for business entities) You must provide accurate, current, and complete information during the registration process and keep your Render Booking Account information up to date at all times. Any changes on any of it shall have to be updated with Render Booking immediately and shall be re-verified by the Render Booking accordingly. Render Booking may set additional requirements based on the information provided.4. Eligibility and Registration for Clients
To use Render Booking's Services, clients must meet the following eligibility criteria: Provide a valid phone number. Provide a valid email address. Provide accurate, current, and complete personal information. Clients must always keep their Render Booking Account information up to date. By registering with Render Booking, clients agree to follow our terms and conditions, including our policies on dispute resolution and prohibited activities. Render Booking may verify the information provided and set additional requirements if necessary.5. Verification for Merchants/ Vendors and Clients
Where permitted, Render Booking has the right, but not the obligation, to conduct screenings and checks to (1) help verify the identities of users, including driving history and driver’s license validity, and (2) verify vehicle details. Render Booking does not endorse any vehicle, user, or user’s background, nor do we commit to any specific screening process. We may, at our sole discretion, use third-party services to verify the information you provide and obtain additional related information and corrections where applicable. You authorize Render Booking to request, receive, use, and store such information. We may permit or refuse your request to book or list a vehicle at our sole discretion. Render Booking will not allow or restrict the double registration of a vehicle as it may create issues while booking a vehicle. While Render Booking may undertake efforts to ensure the safety of vehicles shared through our services, we do not make any representations about, confirm, Page 7 of 19 or endorse the safety, roadworthiness, or legal status of any vehicles shared via our platform. Business partners' sole responsibility is to ensure their vehicles are in safe and operable condition, are legally registered for public roads, are not subject to any safety recalls, and meet our vehicle eligibility requirements.5.1 Your Commitments
You agree to always use your Render Booking Account and the Services in compliance with these Terms and Conditions, applicable laws, and any other policies and standards provided to you by Render Booking.5.2 Account Activity
You are solely responsible for all activity through your Render Booking Account. Keep your account information, including your password, secure. You agree not to disclose your password to any third party and to take full responsibility for any activities or actions under your Render Booking Account, whether or not you authorized such activities or actions. You will immediately notify Render Booking of any actual or suspected unauthorized use of your account. We are not responsible for your failure to comply with this clause or for any delay in shutting down or protecting your account unless you have reported unauthorized access to us.6. Prohibited Activities
When using or accessing our Services, you agree that you will not, and will not assist or encourage others to: Breach any local, state, national, or international law or regulation. Submit inaccurate, misleading, or fraudulent information, including false personal or business details. Use or reproduce content that belongs to Render Booking or other users without permission. Use our brand, trademarks, or any confusingly similar identifiers without authorization. Not pay fees or other amounts owed. Fail to deliver or return booked items as agreed. Harass, abuse, or discriminate against other users. Use the Services to transmit harmful or invasive content. Use the Services for commercial purposes not related to Render Booking. Promote other services to Render Booking users without permission. Disrupt the Services through hacking, spreading malware, or similar activities. Bypass security measures or access non-public areas of the Services. By adhering to these guidelines, you help maintain a safe and reliable platform for all Render Booking users.7. Dispute Resolutions
At Render Booking, we are committed to ensuring a smooth and satisfactory experience for all our users, including travelers, business partners, and clients. In the event of a dispute, we have established a clear and fair resolution process to address any concerns promptly and effectively. The dispute resolution processes are as follows:7.1 Initial Communication
For Clients: If you encounter any issues with a booked service, we encourage you to communicate with the Merchant (Final service provider) directly to seek a resolution. Page 9 of 19 For Merchants/ Vendors: If there is a disagreement with a client (Service User), please attempt to resolve the matter directly with the client courteously and professionally.7.2 Escalation to Render Booking
If direct communication does not resolve the issue, either party can escalate the dispute to Render Booking by contacting our 24/7 customer support team. Provide detailed information about the dispute, including booking details, the nature of the issue, and any communication or evidence related to the matter.7.3 Render Booking Mediation
Our team will review the submitted information and may request additional details or documentation from both parties. We will act as a neutral mediator, aiming to facilitate a fair resolution based on the evidence and information provided.7.4 Resolution and Follow-Up
Render Booking will propose a resolution based on our policies, the nature of the dispute, and the evidence provided. Both parties will be notified of the proposed resolution, and we will work to ensure that any agreed-upon actions are implemented promptly. If the dispute remains unresolved, Render Booking will document the case and may suggest further steps, which could include legal action if necessary.7.5 Commitment to Fairness
Transparency: Render Booking ensures that all parties involved in a dispute are treated fairly and transparently. Documentation: We maintain detailed records of all disputes and resolutions to help prevent future issues and improve our services. Support: Our customer support team is available 24/7 to assist with any disputes, ensuring that concerns are addressed quickly and efficiently.7.6 Legal Considerations
Binding Agreements: All users (Merchants/ Vendors & Service Users) of Render Booking's Services agree to adhere to our terms and conditions, including dispute resolution terms. Jurisdiction: Disputes may be subject to the jurisdiction of the relevant local, state, or national courts, as outlined in our terms and conditions. Render Booking strives to create a trustworthy and reliable platform for all users. By following our dispute resolution process, we aim to resolve conflicts amicably and maintain the integrity of our services. Thank you for your cooperation and commitment to a fair and enjoyable travel experience.8. Other Legal Matters
8.1 Violation
Render Booking reserves the right, but is not obligated, to investigate and address violations of this Agreement. We may pursue legal action or refer such matters to law enforcement to the fullest extent allowed by law. Render Booking reserves the right to remove or disable access to any content that we, at our discretion, find objectionable, in violation of our Terms and Conditions, or harmful to our services or community. If we believe you are abusing Render Booking, our users, or Page 11 of 19 any other person, or violating any of our Terms, we may limit, suspend, or terminate your account and access to our services, remove content, deny damage claims, adjust your listings, reduce or eliminate discounts, and take technical or legal steps to prevent your use of our services. Additionally, we may refuse or terminate access to our services to anyone at our discretion, as permitted by law.8.2 Policy Enforcement
When issues arise, we may consider a user's history and specific circumstances in applying our policies. We might be more lenient to ensure fairness, at our sole discretion.8.3 Communications with Merchants/Vendors, Clients
You agree that Render Booking may contact you electronically (e.g., by email, or app notifications) instead of through mailing notices. To reach you more efficiently, we may also use calls or text messages at your phone number(s), but not for marketing purposes. These communications may be to confirm your signup, provide account notices, investigate or prevent fraud, collect debts, or convey urgent messages. We may share your phone number(s) with merchants/ vendors to help with these communications, but not with third parties for their use without your consent. If required, you may revoke your consent for such communications. Render Booking may contact you at any time for the purposes mentioned above.8.4 Non-Disparagement
Both parties agree not to harm each other's reputation or take any actions that could lead to negative publicity for the other party.9. Specific terms for Merchants/ Vendors
The following sections apply if you share your vehicle through our services:9.1 Merchants/ Vendors Commitments
As a Business Partner or Merchant/ Vendors, you agree to: Provide a safe, legally registered, and insured vehicle with current license plates and a clean title, in good mechanical condition. Deliver the vehicle on time. Ensure your listings are complete and accurate, honoring all representations and quoted prices. In case of a vehicle swap, clients shall not be compelled to accept an alternative with a higher-priced or upgraded version of the vehicle. Not cancel a booking to seek a higher price from another client. Only offer vehicles or optional extras that you own or have the authority to share, and that comply with any third-party agreements. Confirm that sharing your vehicle does not violate any lease, loan, or financing agreements. Ensure any offered extras are safe, clean, and suitable for their intended use. Not offer vehicles that are missing, stolen, subject to a safety recall (unless resolved), or not roadworthy. Remove any firearms or weapons from the vehicle before providing it to a client. Grant Render Booking limited power of attorney to retrieve account information from third parties, such as toll agencies, on your behalf.9.2 Vehicle Listing Conditions
When you sign up for Render Booking, you will identify the passenger vehicles you want to list for sharing. Each vehicle must meet Render Booking's requirements. You may only use the services for vehicles that you own or have the necessary rights and permissions to share for compensation and avoid multiple listings of the same vehicle.9.3 Vehicle Availability
Once a trip is booked, you must make the vehicle available or deliver it as expected by the client. If you offer the client the option to pick up at a specified location, you must accurately provide this location to Render Booking and ensure the vehicle is available there at the start of the reservation period. To qualify for protection plans, you must verify that the prospective client is the one who booked the service.9.4 Maintenance and Safety
You must regularly check your vehicle for any defects in operation or safety. You promise that your vehicle will always be in a safe, roadworthy, and good mechanical condition, meeting all inspection and registration requirements. You will only list vehicles with a clean title. You agree to address any recall or safety notices and complete any recommended actions before allowing your vehicle to be booked. If Render Booking believes your vehicle does not meet reasonable standards, we may notify you and remove or decline your listing until the issues are resolved. Render Booking may but is not obligated to, take steps to ensure the safety of vehicles booked through our services.9.5 Pricing, Earnings, and Payments
Merchants/ Vendors can set and adjust their vehicle’s pricing as they choose. Render booking shall not be liable for any further ride other than the predefined one. Render Booking will pay you the amount collected from clients who book your vehicle after deducting applicable fees. A description of fees can be found on the bill/ invoice submitted by Render Booking and will be visible in your merchants/ vendors dashboard too. If you owe Render Booking or any third party money for any reason, Render Booking reserves the right to deduct those amounts from your earnings, debit your bank account, charge any payment methods on file, and/or send you a bill/ invoice.9.6 Payment Processing
Render Booking will process payments through direct bank transfer or the digital wallet, Khalti. First, Render Booking will receive the booking payment from the client. The merchants/ vendors will receive their amount within 24 hours of the client's departure.9.7 Physical Damage and Missing Vehicle
Render Booking shall not be liable for any physical damage or loss of the service vehicle during the service period or any other damage or losses caused by the act of the client. Any issues arising due to client actions must be resolved directly between the client and the merchant.9.8 Indemnification of Merchants/ Vendors, Client
Render Booking shall not be liable to provide indemnification to merchants or clients for any losses or damages incurred by the act of either party.10. General Provisions
These terms, along with any policies or guidelines referenced herein, constitute the entire agreement between you and Render Booking and replace all prior understandings or agreements, written or oral, regarding the use of our Services. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. These terms will be governed by and construed by the laws of Nepal, without regard to its conflict of law principles. You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign or transfer our rights and obligations under these terms at our discretion. We reserve the right to modify these terms at any time. Any changes will be effective upon posting on our website. Your continued use of our Services following the posting of changes constitutes your acceptance of such changes. The headings used in these terms are for convenience only and will not affect the interpretation of these terms. Render Booking will not be liable for any failure or delay in performing its obligations under these terms if it is due to causes beyond our reasonable control, including natural disasters, war, acts of terrorism, labor disputes, governmental actions, or interruptions in internet services. These terms, together with any updates, form a binding agreement that outlines the legal relationship between Render Booking and its users, ensuring a fair and consistent understanding of our mutual obligations and rights.For any inquiries or support, our dedicated customer care team is available 24/7.
