In Renderbooking.com, a Private limited company incorporated under the laws of Nepal, with its registered address in Maharajgunj, Kathmandu, Nepal, is referred to as "us," "we," or "our." The (mobile) website and app through which the Trip Service is made available are referred to as the "Platform." "Trip" refers to the many travel items and services from the Trip Provider that you can obtain, acquire, purchase, buy, pay, rent, provide, reserve, combine, or finish.
Our vendors, Tour packages, and the personnel who are responsible for providing you with service are referred to as 'Trip Providers.’
Different abbreviations used such as TCs are referred to as Terms and Conditions, B2B- Business to Business, B2C- Business to consumers.
These terms and conditions, as revised from time to time, apply to any of our services made available online, through any mobile device, by email, whether directly or indirectly. You acknowledge and agree to have read, understood, and agreed to the terms and conditions set forth below by accessing, browsing, and using our website or any of our applications through whatever platform and/or by completing a reservation.
Such pages, their content and infrastructure, and the online reservation service including payment facilitation provided by us on these pages and through the website is owned and operated by renderbooking.com for your personal, non-commercial (B2C) use only, subject to the terms and conditions set forth below. The business relationship we have with each of these Trip Providers is regulated by distinct terms and conditions that govern the (B2B) commercial relationship we have with each of them. When making its product and/or service available on or through Renderbooking.com (both for its business-to-business ("B2B") and/or business-to-consumer ("B2C") connection), each Trip Provider acts professionally toward Renderbooking.com.
Please be aware that Trip Providers may have, declare applicably, and/or require acceptance of their own terms and conditions and house rules for the use, availability, and finalization of the trip in addition to the policies and fine print as disclosed on the website.
1. Scope and nature of our Service
We provide an online platform through which Trip Providers can advertise, price and promote their services for order, purchase, reservation, rent, or hire, as well as relevant Platform visitors, can discover, search, compare, and, reserve, purchase, or pay through the Platform. You enter into a direct legally binding contract with the Trip Provider when you use the Trip Service. We function exclusively as a middleman between you and the Trip Provider from the time at which you make your Trip Reservation. We forward your Trip Reservation details to the appropriate Trip Provider(s) and send you a confirmation email on their behalf. Renderbooking.com does not (re)sell, rent, or provide any type of product or property.
The information we divulge when providing our Trip Service is based on information submitted to us by Trip Providers. As a result, Trip Providers that market and promote their Trip on the Platform are allowed access to our systems, and they are solely responsible for updating all rates/fees/prices, availability, offers, policies & conditions, and other pertinent information presented on our Platform.
Although we will perform our Trip Service with reasonable skill and care, we cannot guarantee that all information is correct, finalized, or accurate, nor can we be held liable for any inconsistencies (including manifest and typographical errors), interruptions due to any temporary breakdown, restoration, upgrade, or maintenance of our Platform. Each Trip Provider is solely responsible for the reliability, thoroughness, and accuracy of the information presented on our Platform (including rates/fees/prices, policies & conditions, and availability). Unless otherwise stated, our Platform does not constitute and should not be construed as a recommendation or endorsement of any Trip Provider's quality, service level, qualification or (star) rating, type of accommodation, or facilities, venue, vehicles, products, or services made available. Our Trip Service is made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, reservations, tickets, products, or services available on our Platform for any commercial or competitive activity or purpose.
The pricing provided by our Platform's Trip Providers is extremely competitive. Unless otherwise mentioned on our Platform or in the confirmation email/ticket, all prices for your Trip include VAT/sales tax and all other taxes (subject to change) and fees. Ticket rates are per person or per group, and are subject to the ticket's validity or expiration date, if applicable. In the event of a no-show or cancellation, the Trip Provider may charge applicable fees and taxes (including tourist/city tax).
On occasion, cheaper rates for a given stay, product, or service are offered on our Platform; however, these rates made available by Trip Providers may be subject to additional restrictions and conditions, such as being non-cancelable and non-refundable. Prior to making your reservation, please thoroughly check the relevant product, service, and reservation conditions, and details for any such conditions.
3. Free of charge for consumers, only Trip Providers pay.
Unless otherwise stated, our service is free to customers since, unlike many other companies, we do not charge for our Trip Service or add any additional (reservation) costs to the pricing. You will pay the Trip Provider the amount specified in the Trip Reservation (plus any applicable taxes, levies, and fees (if any) that are not included in the price).
Trip Providers pay Renderbooking.com a commission (a tiny percentage of the product price (e.g. room price)) after the end-user has used the Trip Provider's service or product (e.g. when the guest has stayed at (and paid for) the lodging). Increased commissions can help trip providers improve their ranking (Visibility Booster). The usage of the Visibility Booster (raising commission in exchange for higher ranking) is at the discretion of each Trip Provider and may be employed from time to time and product to product. When setting the Default Ranking, the ranking algorithm will take an increase in commission into account. Preferred partners pay a greater commission in exchange for a higher ranking position.
Only Trip Providers that have a business relation with Renderbooking.com (via an agreement) will be able to use the Platform (for B2B and/or B2C product promotion). Renderbooking.com is not an open platform where end users can advertise their items (no C2C platform); Renderbooking.com does not allow non-related parties to advertise or market their goods on or through Renderbooking.com.
4. Credit payment or bank transfer
Certain Trip Providers, if applicable and available, allow Trip Reservations to be paid (wholly or partially, as needed by the Trip Provider's payment policy) to the Trip Provider by secure online payment during the Trip Reservation process (all to the extent offered and supported by your bank). Renderbooking.com enables (via third-party payment processors) the payment of the applicable product or service (i.e. the payment facilitation service) for and on behalf of the Trip Provider for certain products and services (RenderBooking.com never acts nor operates as the merchant of record). A third-party payment processor securely transfers funds from your credit/debit card or bank account to the accommodation provider's bank account.
Any payment assisted by us for and on behest of the Trip Provider and transferred to the Trip Provider will be deemed a payment of (part of) the booking price of the relevant product or service by you in final settlement of such due and payable price, and you will not be able to reclaim such additional money.
Please note that for certain (non-refundable) rates or special offers, Trip Providers may need payment in advance by wire transfer or credit card, and your credit card may be pre-authorized or charged when you make the Trip Reservation. Prior to making your Trip Reservation, please thoroughly check the booking details of your product or service of choice for any such conditions. You will not hold Renderbooking.com answerable or responsible for any incorrect charge by the Trip Provider, and you will not be able to (re)claim any amount for any valid charges by the Trip Provider of your credit card which includes pre-paid rates, no-show, and chargeable cancellations.
5. Pre-payment, cancellation, no-show, and fine print
By making a Trip Reservation with a Trip Provider, you are accepting and agreeing to the Trip Provider's relevant cancellation and no-show policy, as well as any additional terms and conditions that may apply, including for services rendered and/or products offered. A Trip Provider's terms and conditions can be obtained from the Trip Provider itself. Each Trip Provider's general cancellation and no-show policy is published on our Platform on the Trip Provider information pages. Please keep in mind that some rates, levies, or special offers are not refundable or changeable. In the event of a no-show or chargeable cancellation, the Trip Provider may still charge the applicable tax. Please properly review the details of your chosen product or service for any such conditions before making your reservation. Please note that if the relevant amount(s) could not be collected in full on the relevant due or payment date in conformity with the Trip Provider's payment policy, a Trip Reservation that necessitates down payment or advanced payment may be canceled (without prior notice or warning).
Each Trip's cancellation and prepayment policies may differ depending on the segment, product, or service. Please read the details below each Trip Provider's page on our Platform and also read the information in your reservation confirmation carefully for any additional policies that the Trip Provider may apply (e.g., age requirement, security deposit, non-cancellation, extra beds, etc) late payment, incorrect bank information and card details, invalid credit/debit cards, or inadequate funds are entirely at your own risk and expense, and you will not be entitled to a refund of any (non-refundable) prepaid amount unless the Trip Provider agrees or allows otherwise according to their payment policy.
Please return to the confirmation email and follow the instructions therein if you desire to review, alter, or cancel your Trip Reservation. Please be aware that you may be charged for your cancellation in line with the Trip Provider's cancellation, (pre)payment, and no-show policies or you may not be entitled to any (pre)paid amount refund. We urge that you read the hotel's cancellation, (pre)payment, and no-show policies carefully before making your reservation and that you make any additional payments required for the reservation on time.
If you arrive late or late on the check-in date or only come the next day, make sure to (timely/promptly) notify the Trip Provider so they know when to expect you. Otherwise, your Trip (Reservation) may be canceled, and you may be charged a no-show fee. If necessary, our customer service department can assist you in informing the Trip Provider. Renderbooking.com assumes no obligation or responsibility for the consequences of your late arrival, as well as any cancellation or no-show fee imposed by the Trip Provider.
6. (Further) correspondence and communication
By completing a Trip Reservation, you agree to receive (i) an email which we may send you shortly prior to your arrival date, giving you information on your destination and providing you with certain information and offers (including third party offers to the extent that you have actively opted in for this information) relevant to your Trip (Reservation) and destination, (ii) an email after arrival to rate the (experience with your) Trip Provider and the Trip Service, and (iii) an email which we may send to you promptly after your stay inviting you to complete our guest review form. See our privacy and cookies policy for more information about how we may contact you.
Renderbooking.com disclaims any liability or responsibility for any communication by or with the Trip Provider on or through its platform. You cannot derive any rights from any request to, or communication with the Trip Provider or (any form of) acknowledgment of receipt of any communication or request. Booking.com cannot guarantee that any request or communication will be (duly and timely) received/read by, complied with, executed, or accepted by the Trip Provider.
In order to duly complete and secure your Trip Reservation, you need to use your correct email address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address or inaccurate or wrong (mobile) phone number or credit card number.
Any claim or complaint against Renderbooking.com or in respect of the Trip Service must be promptly submitted, but in any event within 30 days after the scheduled day of consummation of the product or service (e.g. check out date). Any claim or complaint that is submitted after the 30 days period, may be rejected and the claimant shall forfeit its right to any (damage or cost) compensation.
Due to the continuous update and adjustments of rates and availability, we strongly suggest making screenshots when making a reservation to support your position (if needed).
7. Ranking, stars, and guest reviews
By giving a customized default ranking of Trip Providers on our Platform, we hope to display search results that are relevant to you. You can go through this default ranking, apply filters, and sort by other ranking orders to impact how search results are presented and receive a ranking order based on other criteria. We use a variety of algorithms to generate default ranking results, and this process is always changing.
The default ranking, as well as the Trip Provider's track record on prompt payment, may be influenced by the commission percentage given by the Trip Provider or other benefits to us (e.g., through commercial relationships with the Trip Provider or strategic partners).
The star rating given to accommodation on Renderbooking.com is not determined by Renderbooking.com. The star rating is either decided by the establishment itself or by an independent third-party provider of star ratings. The number of stars that providers offer to Renderbooking.com determines which deals are displayed. The star classifications are either issued by an (independent) third party, such as an (official) hotel rating organization or are based on the opinion of the lodging providers themselves, irrespective of objective criteria, depending on the (country) rules and criteria. Renderbooking.com has no established requirements for star ratings and does not review them. Overall, the star rating represents how the lodging compares to regulatory criteria (if applicable) or, if not, sector or (customary) industry norms in terms of price, amenities, and available services.
Renderbooking.com will allow only clients who have stayed at the appropriate lodgings to remark on their stay and submit a score for particular areas of their stay, or they may receive a rating request during their stay.
The completed guest review may be (a) uploaded to on our platform under relevant Trip Provider's information page and (b) (wholly or partly) used and placed by Renderbooking.com at its Platform or such social media platforms. Evaluations can only be submitted within a certain amount of time after a stay, and each review will only be viewable for a certain amount of time after it is posted, in order to provide and retain recent (and thus relevant) reviews. The ranking of reviews is by date of submission in relation to a few other factors (such as language and reviews with comments), but a review from a customer who [always] writes extensive and detailed reviews may be ranked first. The Trip Provider can comment on a review on Renderbooking.com. In the event that a review breaches our review policy, we have the right to adjust, refuse, or remove it at our sole discretion. Customers are not compensated or otherwise rewarded for leaving a review on Renderbooking.com. The guest review form should be considered a survey, as it contains no (additional commercial) offers, invitations, or incentives. Renderbooking.com pledges to monitor and remove reviews that contain profanity, mention of a specific individual's identity, or mention of stolen items.
Renderbooking.com does not accept reviews that mention the following:
- Profanity, sexually explicit language, hate speech, discrimination, threats, and violence are all examples of profanity.
- Full identities are mentioned, and there is a personal attack on the personnel.
- Encouragement of illicit activities (e.g. drugs)
- Sites, email addresses, phone numbers, and credit card information
- Politically charged remarks
Renderbooking.com and the Trip Provider are each entitled to end their agreement for any reason (including breach of contract or (filed for) bankruptcy), provided that the necessary notification time as agreed between both parties is followed.
We shall only be liable for direct damages actually suffered, paid, or incurred by you due to an attributable shortcoming of our obligations in respect of our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the Trip Reservation confirmation email, subject to the limitations set out in these terms and conditions and to the extent permitted by law (whether for one event or series of connected events).
However, to the fullest extent permitted by law, none of our officers or affiliated people or those who are involved in creating, sponsoring, promoting creating, or making available the site and its contents shall be liable for (i) any punitive, unique, indirect, or losses incurred or damages, any production losses, loss of profit, or loss of revenue, or any loss of use of the site or its contents, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy in the Trip Provider's information as made available on our Platform, (iii) the Trip Provider's or other business partners' services or products, (iv) any damages, losses, or costs suffered, incurred, or paid by you , or (v) any (personal) injury, demise, property damage, or other (direct, indirect, special, pivotal, or punitive) damages, losses, or costs suffered, encountered, or paid by you, whether as a result of (legal) acts, inconsistencies, breaches, (gross) negligence, wrongful act, omissions, non-performance, false representation, tort, or strict liability by or (wholly or partly) attributable to the Trip Provider or any of our other business.
Renderbooking.com is not responsible for the hotels' use, validity, quality, suitability, fitness, and proper disclosure, and makes no portrayals, warranty claims, or circumstances of any kind, whether inferred, statutory, or otherwise, including any implied merchantability, title or non-infringement. You understand and agree that the applicable Trip Provider is entirely responsible for the Trip and bears all responsibility and liability for it which includes any warranties made by the Trip Provider. The Trip Provider will handle any complaints or claims relating to the Trip (including those relating to the given (special/promotional) price, policy, or particular requests made by Customers).Renderbooking.com is not liable for such complaints, claims, or (product) liabilities and disclaims all duty.
Renderbooking.com is not responsible for remitting, collecting, withholding, or paying the applicable taxes payable on the (Trip) price or fee to the appropriate tax authorities. Renderbooking.com is not the official seller of any product or service offered on the Platform.
Uploading photos/images to our system, you agree that you own the copyright to the photos and you agree that Renderbooking.com may use them on its website and app, as well as in promotional materials and publications, as it sees fit. You are granting Renderbooking.com a non-exclusive, worldwide, irrevocable, unequivocal, everlasting right and license to use, recreate, display, sublicense, transmit, and make available the images in any way that Renderbooking.com deems appropriate. By contributing these photographs, the person posting them acknowledges all moral and legal obligation for any and all legal claims brought by third parties including, but not confined to, hotel owners as a result of Renderbooking.com publishing and utilizing them.
The photos/images that are uploaded are not owned or endorsed by Renderbooking.com. The veracity, validity, and right to use of any photos/images is the responsibility of the person who uploaded the photo, not Renderbooking.com. Renderbooking.com disclaims all liability and accountability for the images posted. The person who uploaded the photo guarantees that the photos/images do not contain any viruses, Trojan horses, or infected files, and that they do not contain any sexually explicit, illegal, inappropriate, demeaning, morally repugnant, or unsuitable material, and that they do not violate any third-party rights (intellectual property, copyright, or privacy). Any photo/image that does not fit the aforementioned criteria will not be posted, and Renderbooking.com reserves the right to remove or delete it at any time and without notice.
In the event of any alleged or reasonably suspected (i) form of fraud or abuse, (ii) non-compliance with applicable laws and/or regulations, (iii) non-compliance with Renderbooking.com values and guidelines, (iv) inappropriate or obscene behavior, Renderbooking.com has the right to deny or limit access to our Platform, our (customer) service, and/or your Renderbooking.com account, and/or cancel a confirmed reservation,
9. Intellectual property rights
Unless stated otherwise, the software required for our services or available at or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by Renderbooking.com B.V., its Trip Providers or providers.
Renderbooking.com exclusively retains ownership of all rights, title, and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the Platform on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the Platform or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to Renderbooking.com. Any unlawful use or any of the aforementioned actions or behavior will constitute a material infringement of our intellectual property rights (including copyright and database right).
10. Applicable law, jurisdiction, and dispute resolution
Renderbooking.com follows Nepalese legislation in its operations. The jurisdiction is international, and in terms of dispute resolution, both parties can decide where to take the matter for resolution.
